The Police have retrieved closed-circuit television (CCTV) camera footage at Quality Shopping Village Naalya in Wakiso district, to ascertain how businessman Arnold Ainebyona Mugisha was killed on Tuesday.
Speaking to Saturday Vision on phone yesterday, Kampala Metropolitan Police spokesperson Patrick Onyango confirmed the development but said the footage was not useful to the investigations.
“We obtained the footage from the surveillance camera at the supermarket, but it was not useful because the cameras were obstructed by a flower and tree,” Onyango said.
Onyango, however, said Ainebyona’s murder is a direct case where a number of eyewitnesses have since appeared at Police to record statements.
“There are many witnesses that have recorded statements regarding the incident and, therefore, we are not bothered with the footage,” Onyango said.
On the security guard who was allegedly knocked, Onyango said: “We are investigating the entire case but our focus is on the murder.”
When asked about the identity of the security guard who was allegedly knocked and his health condition, Onyango said he was not aware of any, but investigations were ongoing.
“Information about the incident continues to come in, but I am not aware of any injured security guard,” he said. Onyango disclosed that Ainebyona’s colleagues will act as key state witnesses once the trial kicks off.
GUARD CHARGED
On Thursday, Moses Ongoria, a security guard accused of killing Ainebyona, was charged with murder before Kira Chief Magistrates’ Court in Wakiso district. Ongoria, 26, was produced in the court presided over by Grade One Magistrate Joan Aciro at about 2:00 pm.
However, he appeared unwell and the magistrate ordered the Police to take him to hospital for treatment before the charges could be read out to him. At about 5:30 pm, he was produced back in court and charged with the murder of Ainebyona, contrary to Section 188 and 189 of the Penal Code Act. The offense attracts a maximum sentence of death on conviction.
However, the magistrate did not allow him to plead to the charges, saying he was facing a capital offense only tried by the High Court. The court heard that investigations in the matter are still going on, prompting the magistrate to remand him until July 26, when he will reappear in court to know the status of investigations in the matter.
The prosecution alleges that on July 9 at Quality Shopping Village Naalya, Ongoria killed Ainebyona with malice aforethought. On Tuesday, Ongoria is said to have shot dead Ainebyona following a scuffle after Ainebyona’s colleagues allegedly pushed a trolley after shopping and hit a car that had been parked adjacent to theirs.
The security guard had an argument with Ainebyona and his two colleagues for rolling a trolley that hit another client’s car at the supermarket. It is said in the process of reversing, Ainebyona knocked at the foot of Ongoria’s colleague identified as Babu Awaze, prompting him to shoot at Ainebyona.
It is reported that it is out of anger that Ongoria allegedly rushed to the sentry box, where he picked his gun and shot Ainebyona in the mouth, causing his death.
AINEBYONA BURIED
The 26-year-old Ainebyona was buried yesterday at his ancestral home in Ntungamo district. During Ainebyona’s funeral service at All Saints Cathedral in Nakasero, Kampala on Wednesday, his father, Eng. Plan Mugisha, implored the Government to control the guns.

Ainebyona attended Lohana Academy and Kibuli secondary school. He then joined King’s College Budo before he went to the UK, where he obtained a degree in real estate management from Oxford Brooks University. He has been one of the owners of Hickory Bar & Restaurant in Kololo, a city suburb.
